RENTAL CONDITIONS 1. RENTAL. 1.a Rental takes place between HIBO YACHTCHARTER (hereinafter referred to as the lessor) of the ship and the renter. 1.b Rental takes place according to the rental contract drawn up by the lessor with the associated rental conditions. 2. RESERVATION. 2.a A reservation is final after the lessor has received the (down) payment of the total rental amount. 3. CONFIRMATION. 3.a After receipt of the reservation, the lessor gives the renter the option on the desired ship until the first payment. 3.b The rental contract is sent to the renter. 3.c The rental contract must be completed and signed by the renter within 5 days, together with a copy of the driver's license or passport if requested, to be returned to the lessor. 4. PAYMENT. 4.a After sending the rental contract by the lessor, 50% of the total rental amount must be paid within 5 days. The remaining amount must be paid no later than 4 weeks before the start of the rental period. 4.b When booking within a period shorter than 3 weeks, the total rental amount must be paid immediately after signing the rental agreement. 4.c The total rental amount includes the mandatory cleaning and administration costs (unless stated otherwise). 4.d The total rental amount does not include the security deposit. This must be paid CASH to the lessor at the start of the rental period. 5. CANCELLATION. In case of cancellation, the following is due: - 5.a up to 12 weeks before the start of the rental period: 15% of the rental amount. - 5.b from 12 to 8 weeks before the start of the rental period: 50% of the rental amount. 5.c from 8 to 4 weeks before the start of the rental period: 70% of the rental amount. 5.d from 4 weeks to 1 day before the start of the rental period 90% of the rental amount..- 5.e from the start date: 100% of the rental amount.. 5.f the lessor will reasonably attempt to rent out the vessel for the same period or part thereof. If this is successful, the cancellation costs will be reduced proportionally. The lessor may retain € 125.00 in administration costs. 6. LIABILITY. 6. a The lessor shall not hold the lessor liable for any personal or material damage suffered by the lessor. The lessor shall not hold the lessor liable for any claims brought by third parties, as well as any costs of legal proceedings, which have arisen as a result of events during the rental period. 7. TERMINATION OF THE LEASE. 7.a The lessor reserves the right to require the lessor to follow a mandatory SSH (SchipperStartHulp) course and/or to immediately terminate the lease agreement in the event of proven incompetence with regard to sailing and/or navigating the ship, without the lessor being liable to pay any compensation and/or refund the rental amount to the lessor. 8. COMPLAINTS. 8.a Complaints relating to the lessor's conduct and complaints regarding the technical condition, inventory and/or equipment of the ship must be reported directly to the lessor. 9. AVAILABILITY. 9.a The lessor undertakes to make the ship available at the start of the rental period in a technically sound condition, with the usual equipment, the prescribed rescue equipment and with the required inventory and documents. 9.b lessor has taken out third-party liability and hull insurance for the ship for the renter, including rental cover. 9.c The renter must identify himself to the lessor before departure by means of an identity document (e.g. passport or driver's license). 9.d The lessor must draw the renter's attention to any damage and/or defects before the start of the rental period and record these in writing for the renter. 9.e ship is made available clean and with filled water, gas and fuel tanks. 9.f The renter must check the ship before taking over using the inventory and checklist. RETURN. 10.a The renter must refuel the vessel at the lessor at the end of the rental period. 10.b The renter must return the vessel to the home port in good time, before the end of the rental period, in the same condition (except for wear and tear) as at the start of the rental period. 10.c If the renter leaves the vessel at a location other than the home port, the costs for transport and delay will be borne by the renter. 10.d The renter returns the vessel tidy and swept clean. 10.e Damages that occur during the rental period must be reported to the lessor by the renter. The damage will be deducted from the deposit. 10.f Any material lost during the rental period must be compensated by the renter. 11. SAILING AREA. 11.a The sailing area includes the insurance area determined by the insurance. Namely: Inland waters of Friesland – Overijssel - Groningen with the exception of the major rivers. and IJsselmeer – Markermeer – IJmeer - Waddenzee – Zwarte meer – Ketelmeer - 11.b In the event of violation of the sailing area, the lessor may immediately take possession of the vessel, without refund of the rental fee and withholding the deposit. 11.c Expansion of the sailing area is only possible if this has been agreed in writing with the lessor 12. DAMAGE OR BREAKDOWN. 12.a In the event of any damage, breakdown, damage, seizure and damage to the vessel, inventory and accessories, the renter shall contact the lessor as soon as possible. The renter must act very carefully in his own interest when accepting assistance. 12.d If necessary repairs, which are the result of damage caused by wear and/or insufficient maintenance, take longer than 48 hours, the renter is then entitled to a proportional refund of the rental fee for the period that he cannot sail with the ship. 13. DEFICIENCIES. 13.a If one of the parties fails to meet its obligations, the other has the right to terminate the contract in whole or in part. This is only different if the deficiencies are of such a special nature or minor extent that termination is not justified. There is also a claim for compensation for any damage, unless the shortcoming cannot be attributed to the other party. 13.b In the event of termination or partial termination due to a shortcoming by the lessor, he will refund any paid rental and deposit in full or in part, respectively. 13.c If the shortcoming consists of the failure to deliver the vessel on time, the lessor is entitled to compensation. 13.d If the shortcoming by the lessor spoils the holiday in whole or in part, the lessor is also entitled compensation for this. 13.e The lessor's liability in the event of shortcoming is limited to a maximum of the rental sum paid by the lessor. 13.f If the renter returns the vessel later than agreed, the lessor is entitled to a proportional increase in the rental fee and compensation for further damage, unless the late return cannot be attributed to the renter. 14. APPLICABLE LAW AND DISPUTE RESOLUTION. 14.a This rental agreement is subject to Dutch law. Only the Dutch court, or the dispute resolution body established in the Netherlands designated by both parties, is authorized to hear disputes. 15. GENERAL. 15.a The renter is not permitted, among other things, unless with the written permission of the lessor: to stay on the vessel with more crew members than the number stated on the reservation or rental agreement form. 15.b - to participate in competitions. 15.c - to keep pets on board without the express permission of the lessor (additional cleaning costs will be charged for this). - 15.d to make changes to the ship and equipment. - 15.e to sail in unfavourable weather conditions or forecast of unfavourable weather conditions (wind force 5 or more and in fog, etc.) - 15.f to sail or anchor after sunset to spend the night - 15.g to sublet the ship or to allow others to use it. - 15.h to tow other vessels. 15.i Compensation for damage caused by the renter or passengers under the influence of alcohol, drugs or medication is excluded by the ship's insurance. 15.j Costs directly related to the use of the ship, such as harbour, bridge, quay, lock and mooring fees, as well as fuel costs, are for the account of of the lessor. 15.k The necessary costs of normal maintenance and of repair, towing assistance and salvage in case of mechanical defects are for the account of the lessor. If these costs exceed the amount of € 115,-, the lessor must be contacted in advance and permission must be requested, unless this is impossible due to circumstances. Reimbursement of the costs incurred is preferably made upon presentation of specified invoices. The tenant must take replaced parts with him for the lessor if possible. 15.l The lessor declares to handle the ship and the equipment as "a good skipper", to be familiar with the sailing regulations and to observe them. 15.m In the event of a breach of these conditions, the lessor may immediately take possession of the ship, without refunding the rental fee and withholding the deposit. 15.o This contract has been translated with Google.
